1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Kintana websites, applications, and related services (collectively, the "Service") operated by Kintana ("we", "us", or "our"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Kintana provides tools for event ticketing, customer relationship management, marketing pages, and related workflows for organisers, performers, venues, and their teams. Features may change over time. We may suspend or discontinue parts of the Service with reasonable notice where practicable.
3. Accounts and workspaces
You may need an account to use administrative features. You are responsible for safeguarding your credentials and for activity under your account. Workspaces may be created for organisations or individuals; administrators are responsible for inviting users and managing permissions.
4. Acceptable use
You agree not to misuse the Service. For example, you must not:
- Violate applicable law or infringe others' rights;
- Attempt to gain unauthorised access to systems, data, or accounts;
- Interfere with or disrupt the Service or other users;
- Use the Service to send unlawful, harmful, or deceptive communications;
- Reverse engineer or scrape the Service except as allowed by law.
5. Customer content
You retain rights to content you submit ("Customer Content"). You grant us a licence to host, process, display, and distribute Customer Content as needed to provide and improve the Service, including sharing it with end users (for example, event pages and ticket buyers) as you configure.
6. Fees and payments
Paid features, ticket sales, and payouts may be processed through third-party payment providers (such as Stripe). Fees, taxes, refunds, and chargebacks are handled according to your settings, our pricing where applicable, and the payment provider's terms. We are not responsible for third-party payment failures beyond our reasonable control.
7. Third-party services
The Service may integrate with third-party products (payments, email, analytics, advertising platforms, etc.). Your use of those products is subject to the third party's terms and privacy policy.
8. Intellectual property
The Service, excluding Customer Content, is owned by Kintana and its licensors. Except for the limited rights granted in these Terms, no rights are transferred to you.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, Kintana and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of amounts you paid us for the Service in the twelve months before the claim or one hundred Australian dollars (AUD $100), except where liability cannot be limited by law.
11. Indemnity
You will defend and indemnify Kintana against claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your violation of these Terms, or your violation of others' rights.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we need to protect the Service or other users. Provisions that by their nature should survive will survive termination.
13. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the updated Terms, to the extent permitted by law.
14. Governing law
These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.
